Excellent Buying Experience! To buy a home in a state where you don’t know anybody is challenging. I was a buyer and Elizabeth Cabradilla was my realtor for a home I was under contract to purchase. She went to extreme measures to promote the sellers’ interests despite her professional and contractual obligations to represent me, the buyer. This included interfering with inspections and going behind my back to try and cancel one inspection I had scheduled. She also attempted to get me to sign an addendum that would have given up my rights to the inspection period, although she told me it was to extend the inspection period. If you feel like reading the whole story, it is below although, character limits prevent me from including all the details.
During the home inspection, Elizabeth kept making small talk with the inspector and distracting him from his inspection. I twice asked her to stop by kindly saying "We should really stop talking to him so he can focus and get on with his work." She ignored this both times and continued to talk with him. Every time the inspector wanted to show me a problem he had found, she would interrupt him to make excuses, minimize or flat out deny the problem.
After the home inspection, I told Elizabeth I would not be comfortable buying the house without an HVAC inspection and a foundation inspection. She continued to deny these problems and encouraged me not to have the inspections recommended by my home inspector.
I scheduled inspections and called Elizabeth to ensure that this would be within the inspection period. She confirmed that it would happen within the inspection period.
I then got a text from her telling me she had sent me "a form to sign that will buy us a few days." I never asked for the inspection period to be extended and she had assured me that it would not be necessary. I read the addendum that she sent me to sign and all it said was "Buyer will not be able to submit inspection reports within the allotted 10 business days due to scheduling conflicts with inspectors." This was not only false but that is all it said. It said NOTHING about extending the inspection period. That addendum, as she wrote it, says nothing more than I am failing to meet my obligations under that clause of the contract. As a former attorney, I would also say that in consequence of signing that addendum, I would have given up any rights/benefits under that clause, i.e. the right to terminate the contract within 10 business days if inspections are unsatisfactory. I refused to sign the addendum.
On the day of the HVAC inspection, the technician called me, frustrated/confused. He asked if I was the one who had ordered the service call. He then said he was confused about whether he was still needed out there. I said, "oh you must not have talked to my realtor yet." He responded, "No, I did talk to her and that is why I am confused. She said the air conditioner is working perfectly fine so I am not sure if I still need to come out."
Elizabeth did not call me until 10 minutes later. Elizabeth says she "just talked to the tech and he is 20 minutes away." This was not true, based on my conversation with him (he would have been there by that time) but she did not know I had given him my number to call as well as hers. She says she is not available to let him in but has another agent 25 minutes off. I told her I had already spoken to the technician and he informed me she told him "the AC is working perfectly fine". I told her he expressed confusion as to whether he was needed because of this. She immediately denied it by saying "I never even talked to him." There was a very long pause and she realized her mistake. She then changed her story to "Well, I talked to him but all he asked me was if the AC was on or off and I told him it was on." This is such a ridiculous lie. First of all, the technician had no reason to lie about what she told him. Second, what he was told by her (that the AC was working "perfectly fine") is exactly what she had been telling me at least twice a day for the last week. Finally, this is not a question an HVAC tech would ask, he knows how to turn a unit on and off.
