I am filing a complaint against CMI general contractors for the following reasons. Breach of contract and intentional misrepresentation/Fraud. Myself and CMI executed a written contract for demolition services related to a construction project in San Diego, California. CMI immediately accepted a 20k refundable deposit. Due to circumstances outside my control, I was unable to proceed with the project. I immediately notified CMI and exercised my right to terminate the contract less than a month after signing the Contract. At no time had CMI began working on the demolition of the project before I noticed them of termination. Zero demolition services had been conducted. I was informed and believe and thereon alleges that CMI, and each of the owners, did not incur costs or lost profits that would entitle them to maintain possession of the $20,000.00 deposit. By way of example, CMI did not begin mobilization, order materials or equipment, prepare the facility, nor any incur any other pre-construction costs, as I did not even have possession of the location of the project. I wrote and verbally requested that CMI on multiple occasions requesting the return of the deposit; however, Mr. Connelly refused. Throughout, Mr. Connelly also communicated multiple false statements to myself in coerce them into awarding CMI the project; intentionally omitting essential project items (e.g., water heater, lighting packages, design finishes, etc.) in order to create the illusion of a lower project bid/estimate only to be added later after the project was awarded to CMI to induce myself and exponentially increasing project costs; falsifying records and documents to deceive me into believing work had been done on the project; multiple representations and assurances that the deposit is completely refundable . Likewise, Mr. Mansell (the other partner) also communicated multiple false statements to myself in order to coerce and deceive me into tendering the $20,000.00 deposit and award themselves the project. At the time, I was induced by CMI, and I was unaware of the concealed and/or suppressed facts and would not have acted if I had known the truth of those facts.
